Tribal 8(a) Advantages

 Native American tribes are granted special procurement rights which recognize that proceeds from tribal-owned companies are used for the benefit of the entire tribal membership, rather than individual owners. Unlike individual owners, tribes use these proceeds to build, sustain, and operate their communities for things such as education, law enforcement, health care, public works, etc.

A tribal-owned 8(a) may receive sole-source contracts regardless of the dollar amount. Compared to other 8(a)s, a tribal-owned 8(a) can receive sole-source contracts in excess of $3 million. Also, protests by other contractors are not allowed with respect to a tribal-owned company in connection with such sole-source contracts.

Moreover, Department of Defense primary contractors who utilize tribal-owned enterprises as subcontractors are eligible for a 5% rebate of the amount that was subcontracted.
